Making a Murderer subject Steven Avery has been denied a new trial over the murder of Teresa Halbach.

ABC News reports that a judge has ruled that there was not sufficient evidence to warrant one, despite Avery's new lawyer Kathleen Zellner being confident last year that he would have his conviction overturned.

"The defendant has failed to establish any grounds that would trigger the right to a new trial in the interests of justice," ruled Sheboygan County, Wisconsin, Judge Angela Sutkiewicz. "As such, no further consideration will be given to this issue."

In a statement, Zellner added that they aren't giving up.

"We are filing an amended petition because we have additional test results and witness affidavits," she said.

"The scientific testing is not completed. We remain optimistic that Mr Avery's conviction will be vacated."

Last month, it was announced that the decision to overturn the conviction of Avery's nephew Brendan Dassey will go before an appeals court.

In June, a US federal court ordered that Dassey be freed from prison following a prior decision to throw out his guilty verdict, but his case will now be heard by the full 12-member circuit court on September 26.

Dassey and his uncle were both convicted in the October 31, 2005 killing of Wisconsin photographer Halbach, a case which gripped the world when it was documented in Netflix series Making a Murderer. Both maintain their innocence.
